Agents Regulation 2022 (NSW).\u003C\/strong\u003E\u003C\/p\u003E\r\n\r\n\u003Cp\u003ESection 18 (1) -\u0026nbsp;The following conditions are prescribed as applicable to the sale by auction of land or livestock:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u0026nbsp;\u003C\/strong\u003EThe vendor\u0026#39;s reserve price must be given in writing to the auctioneer before the auction commences unless the auction relates solely to livestock.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b)\u0026nbsp;\u003C\/strong\u003EA vendor bid must not be made unless the auctioneer has, before the commencement of the auction, announced clearly and precisely the number of vendor bids that may be made.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c)\u0026nbsp;\u003C\/strong\u003EThe highest bidder is the purchaser, subject to any reserve price.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(d)\u0026nbsp;\u003C\/strong\u003EIf there is a disputed bid -\u003Cbr \/\u003E\r\n\u003Cstrong\u003E\u0026nbsp; \u0026nbsp; \u0026nbsp;(i)\u0026nbsp;\u003C\/strong\u003Ethe auctioneer is the sole arbitrator, and\u003Cbr \/\u003E\r\n\u0026nbsp; \u0026nbsp; \u0026nbsp;\u003Cstrong\u003E(ii)\u0026nbsp;\u003C\/strong\u003Ethe auctioneer\u0026rsquo;s decision is final.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(e)\u0026nbsp;\u003C\/strong\u003EThe auctioneer may refuse to accept a bid that, in the auctioneer\u0026#39;s opinion, is not in the best interests of the vendor.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(f)\u0026nbsp;\u003C\/strong\u003EA bidder is taken to be bidding on the bidder\u0026rsquo;s own behalf unless, before bidding, the bidder has given to the auctioneer a copy of a written authority to bid for or on behalf of another person.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(g)\u0026nbsp;\u003C\/strong\u003EA bid must not be made or accepted after the fall of the hammer.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(h)\u0026nbsp;\u003C\/strong\u003EAs soon as practicable after the fall of the hammer the purchaser must sign the agreement for sale, if any.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nSection 18 (2) -\u0026nbsp;The following conditions, in addition to the conditions prescribed by subsection (1), are prescribed as applicable to the sale by auction of residential property or rural land:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u0026nbsp;\u003C\/strong\u003EAll bidders must be registered in the Bidders Record and display the identifying number allocated to the person when making a bid.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b)\u0026nbsp;\u003C\/strong\u003ESubject to the condition prescribed by subsection 3(a) -\u003Cbr \/\u003E\r\n\u0026nbsp; \u0026nbsp; \u0026nbsp;\u003Cstrong\u003E(i)\u0026nbsp;\u003C\/strong\u003Ethe auctioneer may make only 1 vendor bid at an auction for the sale of residential property or rural land, and\u003Cbr \/\u003E\r\n\u0026nbsp; \u0026nbsp; \u0026nbsp;\u003Cstrong\u003E(ii)\u0026nbsp;\u003C\/strong\u003Eno other vendor bid may be made by the auctioneer or another person.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c)\u0026nbsp;\u003C\/strong\u003EImmediately before making a vendor bid the auctioneer must announce that the bid is made on behalf of the seller or announce, \u0026ldquo;vendor bid\u0026rdquo;.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nSection 18 (3) -\u0026nbsp;The following conditions, in addition to the conditions prescribed by subsections (1) and (2), are prescribed as applicable to the sale by auction of co-owned residential property or rural land or the sale of co-owned residential property or rural land by a seller as executor or administrator:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u003C\/strong\u003E More than 1 vendor bid may be made to purchase the interest of a co-owner.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b) \u003C\/strong\u003EA bid by or on behalf of an executor or administrator may be made to purchase in that capacity.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c)\u003C\/strong\u003E Before the commencement of the auction, the auctioneer must announce that bids to purchase the interest of another co-owner or to purchase as executor or administrator may be made by or on behalf of the seller.\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(d) \u003C\/strong\u003EBefore the commencement of the auction, the auctioneer must announce the bidder registration number of all co-owners, executors or administrators or a person registered to bid on behalf of a co-owner, executor or administrator.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nSection 18 (4) -\u0026nbsp;The following condition, in addition to the conditions prescribed by subsection (1), is prescribed as applicable to the sale by auction of livestock:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nThe purchaser of livestock must pay the stock and station agent who conducted the auction, or under whose immediate and direct supervision the auction was conducted, or the vendor, the full amount of the purchase price:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u003C\/strong\u003E if the amount can reasonably be determined immediately after the fall of the hammer - before the close of the next business day following the auction, or\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b)\u003C\/strong\u003E if the amount cannot reasonably be determined immediately after the fall of the hammer - before the close of the next business day following determination of the amount, or\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c)\u003C\/strong\u003E if some other time for payment is specified in a written agreement between the purchaser and the agent, or the purchaser and the vendor, made before the fall of the hammer - before or at the time specified in the agreement.\u003C\/p\u003E\r\n\r\n\u003Ch3\u003E\u003Cbr \/\u003E\r\n\u003Cstrong\u003EPRESCRIBED WARNING NOTICES\u003C\/strong\u003E\u003C\/h3\u003E\r\n\r\n\u003Cp\u003E\u003Cstrong\u003ESection 66(4), Property and Stock Agents Act 2002 (NSW) and clause 20(1), Property and Stock Agents Regulation 2022 (NSW):\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003EPENALTY FOR DUMMY BIDDING\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nIt is an offence against the Property and Stock Agents Act 2002 for a person to do one or more of the following -\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a) \u003C\/strong\u003Emake a bid as the seller,\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b)\u003C\/strong\u003E make a bid on behalf of the seller unless the person is the auctioneer,\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c)\u003C\/strong\u003E procure another person to make a bid on behalf of the seller.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nA bid made with the dominant purpose of benefiting the seller constitutes a bid made on behalf of the seller.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nA bid may be found to be a bid made on behalf of the seller even though the seller did not -\u0026nbsp;\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u0026nbsp;\u003C\/strong\u003Erequest the bid, or\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b) \u003C\/strong\u003Eknow about the bid.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nSevere penalties may be imposed on persons convicted of dummy bidding.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003ESection 78 (3), Property and Stock Agents Act 2002 (NSW) and section 20 (2) Property and Stock Agents Regulation 2022 (NSW)\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003EPENALTY FOR COLLUSIVE PRACTICES\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nIt is an offence against the \u003Cem\u003EProperty and Stock Agents Act 2002 \u003C\/em\u003Efor a person to do one or more of the following as a result of a collusive practice, or to induce or attempt to induce another person by a collusive practice to do one or more of the following -\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u003C\/strong\u003E\u0026nbsp;to abstain from bidding,\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b)\u003C\/strong\u003E to bid to a limited extent only,\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(c) \u003C\/strong\u003Eto do another act or thing that might prevent free and open competition.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nSevere penalties may be imposed on persons convicted of collusive practices.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003ESection 83 (2) Property and Stock Agents Act 2002 (NSW) and clause 20 (3) Property and Stock Agents Regulation 2022 (NSW)\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003ESUCCESSFUL BIDDERS\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nThe actual successful bidder at an auction sale must give to the auctioneer or an employee of the auctioneer:\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(a)\u0026nbsp;\u003C\/strong\u003EThe bidder\u0026rsquo;s name, or\u003Cbr \/\u003E\r\n\u003Cstrong\u003E(b) \u003C\/strong\u003EThe name of the person on whose behalf the successful bid was made.\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\n\u003Cstrong\u003EWORK HEALTH AND SAFETY\u003C\/strong\u003E\u003Cbr \/\u003E\r\n\u003Cbr \/\u003E\r\nAll persons attending the sale are advised by the seller that the sale may involve a risk of physical harm, loss and\/or damage. All persons entering and attending the sale do so at their own risk and must take reasonable care for their own health and safety. All persons must also take reasonable care to ensure that their acts or omissions do not adversely affect the health and safety of other persons. The seller does not accept any responsibility for any harm, loss or damage sustained, arising from or in connection with the sale and the items placed and submitted for sale. The seller\u0026rsquo;s agent discloses that it is instructed to conduct the sale in the manner directed by the seller with the items placed and submitted for sale.
